The Prosecutions Case:
On 6th August 2013, the victims in the case, brothers by the name of Taqui and Bourhane Khezihi travelled with two friends Oladapo Tijani and Leon Thompson to a Costcutters shop on the Mall, Ealing Broadway, West London. The time was about 3 pm and there was clear CCTV footage of the men (save for Taqui Khezihi) walking down Northcote Avenue to the shop and returning with drinks and snacks to their car.
The defendants were themselves in the general area of Ealing Broadway. They were all friends, Henry having known Grant-Murray and Tayyib for about 6 years and Ferguson for just under a year. At about 3 pm Tayyib can be seen on CCTV heading towards Northcote Avenue along The Mall and is soon joined by Grant Murray. They separate and Grant Murray enters Northcote Avenue only to emerge a short while later being followed by the Khezihi brothers. Tayyib reappears and Grant Murray points Tayyib towards Northcote Avenue. As he does so he runs into the Costcutters and steals a bottle of wine.
The Khezihi brothers and Tayyib were known to Tayyib and the CCTV footage clearly shows Tayyib acting as a peacemaker between Grant Murray and the brothers, both of whom appear, at the very least, confrontational. The Khezihi brothers had removed their belts to use as knuckle dusters.
The argument/confrontation outside Costcutters appears to have calmed down with the Khezihi brothers being ushered across the Uxbridge Rd by Oladapo Tijani towards Hamilton Rd, where he had moved his car to. All 5 men crossed the road, with Grant Murray still in possession of the bottle. CCTV footage from a bus shows Tayyib and Grant Murray at the junction of Hamilton and Uxbridge Roads.
Henry and Ferguson were walking towards Tayyib’s house and the CCTV evidence showed both men beginning to break into a run as they crossed from the south side of the Uxbridge Rd towards Hamilton Rd.
What happened in Hamilton Rd remains unclear save for two unequivocal facts; Taqui Khezihi was stabbed in the back, his aorta was pierced and he bled to death within an hour of the incident and Bourhane Khezihi was also stabbed in the back but fortunately the wound, although requiring suturing, was relatively minor. What was also clear was that the whole incident in Hamilton Rd was of no more than 50 seconds duration.
Cameron Ferguson pleaded guilty on the sixth day of trial to both murder and section 18, and the evidence was clear that he stabbed Bourhane Khezihi.
The evidence from members of the public as to what happened in Hamilton Road was confused and largely unhelpful in unravelling what each defendant did or not, or to whom. None of the dozen or so civilian witnesses saw any defendant with a knife at all.
The prosecution set considerable store by the actions of the defendants after the stabbing. Ferguson was the first to leave the scene, running south down Northcote Avenue and reappearing from Ealing Broadway shopping centre a matter of minutes later minus his shirt and bag and knife. Henry was the next to exit Hamilton Rd, running along the Mall and linking up with Grant Murray. Undisputed evidence was that Henry, Grant Murray and Tayyib all met in Walpole Park before taking a taxi to the Copley Estate in Hanwell.

On Tuesday the 6th August 2013 I woke up between 10 and 12 midday and was supposed to meet my girlfriend but I hung around the estate where I live with my brother Taqui instead. We were just standing around the front of the estate for about half an hour. We then made our way back to our house, about an hour later ‘’Dapa’’ (his full name Olandapo Tijani) a friend of mine called and said that he was outside. He was in his car a Blue VW Golf. We just hung around outside talking. After a while one of our friends wanted a drink from our house as we were fasting for Ramadan. I also wanted to get credit for my mobile phone. We drove around to a shop on the Uxbridge Road opposite Hamilton Road. We parked up beside the shop. As we pulled up I saw that there were a few people in the street but didn’t take much notice.
As I made my way into the shop everyone else got out of the car, I made my way back to the car and I could see that my brother was talking to a black male wearing a hat (Janhelle Grant-Murray). I walked up to my brother when he told me that they had had words. (CCTV SHOWS BROTHERS FOLLOWING JANHELLE TO THE SHOP). At this point this male ran past me to the shop, and he came out with a bottle of red/pink wine the shop keeper was shouting at him. Janhelle was all chatty he tried to swing the bottle at my brother (CCTV SHOWS THIS DID NOT HAPPEN). I told him to calm down, my brother was telling him we are fasting just relax what’s the problem. I said at one point ‘’just relax we don’t want nothing to do with you, we are fasting. We haven’t got the energy to fight you even if we wanted to’’ (CCTV DISPROVES AND SHOWS BOURHANE REMOVING HIS BELT TO USE AS KNUCKLE DUSTER AND JANHELLE ATTEMPTING TO WALK AWAY WHILE BROTHERS PURSUE ARGUMENT). During this another male (Younis Tayyib) who I know and lives on the road where we first parked joined us. He walked up to me and he is like ‘’what are you doing to my friend, don’t try it with my friend’’ and I said to him ‘’look we are fasting this is my brother, there is no issue here we are gonna walk off’’ (CCTV SHOWS YOUNIS ATTEMPTING TO REASON WITH THE BROTHERS AND STANDING IN FRONT OF JANHELLE TO STOP BROTHERS APPROACHING, HOWEVER BOTH BROTHERS TRY TO GO AROUND YOUNIS TO GET CLOSER TO JANHELLE). At first he was just arguing but there was no indication something like that was going to happen from the argument that was happening. It was just this normal street argument don’t start on my friend, I was like hay I’m going to just move my brother. We went over to the car.
Anyway at that point Janhelle was on the phone saying ‘’bring the nank’’ meaning knife (CELL SITE EVIDENCE SHOWS NO CALL WAS EVER MADE). As we crossed the road I was aware that more guys came running towards us from around the corner one of them said ‘’you fucked now’’. Now there was also a small white guy (Alex Henry) and a bigger black male (Cameron Ferguson).
Younis who is a bit taller than me had me in a bear hug around my neck (BOURHANE ADMITTED IN COURT THAT HE BELIEVED YOUNIS WAS TRYING TO RESTRAIN HIM RATHER THAN HURT HIM). While I was being held I felt a sharp pain in my back (BOURHANE STATES IN COURT THAT HE DID NOT REALISE HE HAD BEEN STABBED UNTIL AFTER THE VIOLENCE). I tried to move Younis off me and I was trying to get to my brother but Younis was holding me. The others were attacking my brother and my brother was just trying to protect me but they kept hitting him (DISPROVED BY PATHOLOGIST REPORTS WHICH SHOWED TAQUI SUSTAINED NO INJURIES CONSISTENT WITH BEING PUNCHED OR KICKED AT ANY TIME, HE ALSO SUSTAINED NO COLLAPSE INJURIES CONSISTENT WITH FALLING TO THE GROUND). Then my brother walked out the way he said ‘’I’ve been stabbed, I’ve been stabbed’’. I said ‘’please just let go of him’’. They continued to hit him (VIDEO FOOTAGE FROM A MOBILE PHONE TAKEN BY A WITNESS, DEPICTS BOURHANE RUNNING AWAY FROM TAQUI TOWARDS THE DEFENDANTS, ATTEMPTING TO REINSTIGATE VIOLENCE AFTER THE AFFRAY HAD ENDED. ALEX, JANHELLE AND YOUNIS ARE SHOWN TO BE WALKING AWAY AND LEAVE THE SCENE. IT APPEARS BOURHANE DOES NOT REALISE THE STABBING HAD TAKEN PLACE UNTIL HE RETURNS TO TAQUI).
When the argument first started I decided to cross the road and get into Dapo’s car. I told Rips that’s what we were going to do Rips replied ‘’yeah no problem’’ and I thought at that point that there was no problem. It was when we crossed the road I first became aware that they were chasing us along with others who appeared to have come from around the corner I think from the Ealing town direction into Hamilton Road they were all around Taqui hitting him, He couldn’t defend himself he was out numbered at least four to five of them (DISPROVED BY PATHOLOGIST REPORTS WHICH SHOWED TAQUI SUSTAINED NO INJURIES CONSISTENT WITH BEING PUNCHED OR KICKED AT ANY TIME, HE ALSO SUSTAINED NO COLLAPSE INJURIES CONSITENT WITH FALLING TO THE GROUND). After Younis held me and I was stabbed he joined in hitting my brother (INDEPENDENT WITNESS STATEMENTS DESCRIBE YOUNIS AS THE PEACE MAKER OF THE GROUP). It was then that Alex Henry hit me in the left eye causing it to bruise. I managed to grab my brother, he began to drop I picked him up and managed to get him to Dapo’s car. I told my friend to drive, the attackers chased the car. (MOBILE PHONE VIDEO EVIDENCE FROM A WITNESS DEPICTS BOURHANE RUNNING AWAY FROM TAQUI TOWARDS DEFENDANTS SOME 30 METRES AWAY. HE ATTEMPTS TO REINSTIGATE THE AFFRAY AFTER THE VIOLENCE HAD ENDED. ALEX, JANHELLE AND YOUNIS CAN BE SEEN TO NOT ENGAGE AND WALK AWAY. IT APPEARS HE DOES NOT REALISE THE STABBING HAD TAKEN PLACE UNTIL HE RETURNS TO TAQUI TO GET HIM INTO THE CAR. THE DEFENDANTS DID NOT CHASE THE CAR AND HAD ALREADY LEFT THE SCENE).
